Expired or Improper Tags in Memphis

Expired tags are one of the most common citations written in Shelby County, and one of the most commonly ignored. Registration violations under Tennessee law are Class C misdemeanors, which means the citation carries a court date — and missing it turns a fixable problem into a warrant. Brooks Law Firm handles registration citations in Memphis and the suburban courts. Call or text 901-412-2973.

What gets written

  • Expired registration. The tag lapsed and was not renewed.
  • Improper display. The plate is obscured, mounted wrong, or the decal is missing.
  • Wrong plate on the vehicle. A tag from another vehicle, which is treated more seriously than a simple lapse.
  • Expired temporary tag. Common after a private sale, and often paired with a title or transfer problem the buyer did not know about.

The good news, and the trap

These are among the most fixable citations there are. Renew the registration, bring proof to court, and prosecutors and judges will very often dismiss or substantially reduce the charge. The problem is almost never the law — it is getting the renewal done and getting to court.

The trap is that people treat an expired tag as trivial, skip the court date, and pick up a capias. Now there are two problems, and the second one is worse than the first. If your tag stayed expired because of cost, say so — the court is a more reasonable audience for that than most people assume, and it is a better conversation than the one that follows a missed date.

When it is not really about the tag

An expired tag is plainly visible from behind, which makes it one of the most common stated reasons for a traffic stop. Many of the tag citations we handle arrived alongside something larger — driving on a suspended license, a drug charge, a weapon. When that happens, the tag is the least of it, and the basis for the stop deserves a close look.

Common questions

Will an expired tag ticket be dismissed if I renew?

Frequently, yes. Proof of a current registration brought to court is the single most useful thing you can do, and courts routinely dismiss or reduce on that basis. It is not automatic and it is not guaranteed.

Do I have to go to court for expired tags in Memphis?

There is a court date on the citation, and it has to be answered. In most routine cases we can appear for you so you do not miss work. What you cannot do is nothing — a missed date produces a warrant.

Is an expired tag a misdemeanor in Tennessee?

Registration violations are Class C misdemeanors. That surprises people, and it is why paying the ticket without thinking about it means pleading guilty to a misdemeanor.
